Welcome to Scene That. These Terms of Service ("Terms") govern your access to and use of the Scene That website, mobile application, and services (collectively, the "Service"), operated by SCENE THAT LTD, registered office: 57 Flemming Avenue, Ruislip, HA4 9LE, United Kingdom. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
Scene That is a platform that allows users to discover, watch, rate, discuss, and categorise specific scenes from videos hosted on YouTube. Furthermore, the Service utilises artificial intelligence to provide users with a personalised experience, serving clip recommendations based on their unique profiles, viewing history, and ratings.
2. Relationship with YouTube and Third-Party Content
Our Service utilises the YouTube Application Programming Interface (API) to display video content. By using Scene That, you acknowledge and agree to the following:
- YouTube Terms of Service: You agree to be bound by the YouTube Terms of Service.
- Google Privacy Policy: Your use of the Service is also subject to the Google Privacy Policy.
- Content Ownership: The video content played through our Service is hosted by YouTube and owned by the respective content creators. Scene That does not generally host, upload, or own any of the video content displayed via the YouTube API. Where we cannot locate the original content owner's channel we may upload certain content onto our own non-monetised channel (Scene That). The intention is to allow our users to rate as much content as possible; please contact us if you are the content owner and share a link to the original content and we would be happy to remove it from our channel and replace it with the original content.
- Content Policies: The video content is subject to YouTube's Community Guidelines and policies. Scene That is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such third-party content.
3. Intellectual Property and Scene That Content
While the underlying video content belongs to YouTube and its creators, Scene That retains all rights, title, and interest in and to the Service itself.
- Our Property: The design, architecture, code, branding, recommendation algorithms, and the aggregation of data on the Service are the exclusive property of Scene That.
- User Contributions: All user-generated ratings, tags, categorisations, and organisational structures created within the Service are the property of Scene That. By submitting ratings, categories, or comments, you grant Scene That a perpetual, irrevocable, worldwide, royalty-free licence to use, display, distribute, and analyse this data, including using it to power and improve our recommendation systems.
4. User Accounts, Personalisation, and Acceptable Behaviour
To utilise certain features, such as leaving comments, rating scenes, or saving favourites, you must create an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. To ensure Scene That remains a safe, legal, and welcoming environment, you agree to abide by the following rules:
- Age Requirements: You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. We do not knowingly collect personal information from children under 13.
- Local Compliance: You are responsible for ensuring that your use of Scene That complies with all local laws and regulations in your country or region. If the Service or the underlying YouTube content is illegal in your jurisdiction, you must not use the Service.
- Personalised Experience: By creating an account and interacting with the Service, you acknowledge that we will use this activity to build a profile of your preferences. We use this profile to serve you AI-driven recommendations tailored to your style.
- No Profanity or Offensive Language: You must not use swearing, profanity, or language intended to cause offence.
- No Harassment or Bullying: You must not insult, harass, threaten, or demean other users, content creators, or individuals.
- No Hate Speech or Discrimination: You must not post content that promotes violence, discrimination, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- No Violent or Graphic Content: You must not post comments or links that depict, promote, or incite violence, self-harm, or illegal acts.
- No Spam or Manipulation: You agree not to post spam, promotional material, or use automated scripts or bots to artificially inflate ratings, categorisations, or comment threads.
Moderation: We reserve the right, but not the obligation, to monitor, review, edit, or remove any comments or user-generated content that we, in our sole discretion, deem to be in violation of these Terms or harmful to the Scene That community.
5. Copyright and DMCA Policy
We respect the intellectual property rights of others. While video content is handled by YouTube's copyright systems, if you believe that any user-generated content on Scene That (such as user comments or text) infringes your copyright, please contact us at Team@scene-that.com.
If you are a copyright owner in the United States, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the relevant information in writing.
6. Termination
We reserve the right to suspend or terminate your account and your access to the Service at our sole discretion, without notice or liability, for any reason. This includes, but is not limited to, a breach of our acceptable behaviour policies or the YouTube Terms of Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Scene That makes no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the Service, our recommendations, or the underlying YouTube content. We do not guarantee that the YouTube API will always be available, and scenes may become unavailable if the original creator removes the video from YouTube.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENE THAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) ANY CONTENT OBTAINED FROM THE YOUTUBE API.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
- For Users Outside the United States: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- For United States Users (Arbitration and Class Action Waiver): If you reside in the United States, you agree that any dispute or claim arising out of these Terms will be resolved by binding, individual arbitration, rather than in court. You and SCENE THAT LTD waive any right to bring or participate in a class action lawsuit or class-wide arbitration.
